The month-of-death payment
Seeing a deposit disappear from the bank after a death is terrifying. Here is the calm version of what that payment usually means.
Under 38 U.S.C. 5310 and 38 CFR 3.20, the surviving spouse of record is generally entitled to the veteran’s compensation (or pension) for the month of death.
VA often pays a month in arrears. When death is reported, Treasury or the bank may flag and recall the final deposit. That recall does not always mean you must permanently return the money — the month-of-death amount can be reissued through the proper claim process.
Filing a Dependency and Indemnity Compensation (DIC) claim within one year of death (or meeting other timing rules your Veterans Service Organization (VSO) confirms) helps protect related rights.
